Know your rights as a tenant
The law is on the shelf. Here’s where to look.
Hawaiʻi’s Residential Landlord-Tenant Code — HRS Chapter 521 — governs nearly every rental on this island. These are the sections tenants ask about most, in plain language, with the section number so you can read the real thing.
§521-44
Security deposits are capped
One month’s rent, held by the landlord — plus at most one more month as a separate pet deposit. It must come back within 14 days of moving out, with an itemized statement for anything withheld.
§521-53
Your landlord can’t just walk in
Except in a genuine emergency, a landlord needs your consent and at least two days’ notice to enter, and only at reasonable times.
§521-42
The home must be habitable
Landlords are required to keep the property fit to live in — plumbing, electrical, structure, and required repairs. Put repair requests in writing and keep a copy.
§521-21
Rent increases need written notice
On a month-to-month agreement, a rent increase requires at least 45 days’ written notice before it takes effect.
§521-71
Ending a month-to-month tenancy
A landlord must give at least 45 days’ written notice to end a month-to-month tenancy; a tenant gives at least 28.
§521-74
Retaliation is prohibited
A landlord may not evict you or raise rent because you complained to an agency or requested repairs you were entitled to.
Read the Code itself: HRS Chapter 521 · The State’s plain-language guide: DCCA Landlord-Tenant Information · Landlord-Tenant Hotline: (808) 586-2634
Plain-language summaries, not legal advice — the Code and its amendments control, and your lease adds terms of its own. For a real dispute, talk to a Hawaiʻi attorney or the Legal Aid Society of Hawaiʻi.
